ANJANA MISHRA ORAL ORDER 27-01-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner No. 1 Mukesh Rai and Petitioner No. 2 Suresh Rai seek to renew their prayer for anticipatory bail though the same was earlier rejected vide order dated 17.08.2015. Learned counsel for the petitioner submits that on merits also, the petitioners are entitled for being extended the interim relief. There is, however, no change in the circumstances which would encourage this Court to venture into second anticipatory bail application.

Under such facts and circumstances, the second bail application is also not maintainable. It is accordingly dismissed. However, if the petitioners surrender before the Court below within a period of three weeks from today, it shall be open to the

Patna High Court Cr.Misc. No.51634 of 2015 (2) dt.27-01-2016 P2/2 Court below to consider the case of the case of the petitioners on its own merits without being prejudiced with the present order passed by this Court.
