JUSTICE SHIVAJI PANDEY ORAL ORDER 06-12-2017 Heard learned counsel for the petitioner and counsel for the State as also counsel for the Informant. The daughter of the Informant is also present, in person, before this Court. In this case, the petitioner is apprehending his arrest in connection with Harnaut P.S. Case No. 140 of 2017 registered for offences under sections 341, 323, 307, 354(A), 354(B), 504, 506/34 of the Indian Penal Code.

In the First Information Report, an allegation has been made against the petitioner that on 12.5.2017 at 6.30 AM, the father-in-law and his grand son (Nati), namely, Bittu @ Amit Kumar entered into the house of the Informant and Bittu, on an instigation made by the petitioner, tried to outrage the modesty of her daughter.

It has been submitted that the husband of the

There is a dispute with respect to the family property, already title suit is going on between the parties and anticipatory bail of Bittu has already been rejected. There is an allegation that the petitioner is instrumental in creating nuisance with an intention that the family member of the Informant should leave the place. It has also been pointed out that the petitioner has already alienated more than his share with an only view to deprive the claim of the Informant and her children.

Looking to the entire facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner, namely, Rana Pratap Singh is rejected.

It is, however, made clear that this order will not come in the way of the petitioner if he surrenders before the court below within a period of four weeks from today. The court below, on the day of surrender of the petitioner, will consider the case of the petitioner and pass orders taking into account the age of the petitioner.
