1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in connection with Banke Bazar P.S. Case No.178 of 2025 instituted under Sections 191(2), 190, 127(2), 115(2), 109, 303(2), 74, 352, 351(2) of the B.N.S., 2023.
3. As per the prosecution case, the informant has alleged that when he was returning his home after closing his shop, in the meantime, all the named accused persons including 7-8 other stopped him and assaulted him by means of various weapons and leave him close to death after snatching his mobile and money. It is alleged that the accused persons some days ago
Patna High Court CR. MISC. No.24467 of 2026(3) dt.12-05-2026 2/3 were found misbehaving with some girls in which one of the girl was informant's daughter due to which the present occurrence took place.
4. Learned counsel for the petitioners submits that petitioners are innocent and have been falsely implicated in this case due to personal enmity and oblique reason. He further submits that there is no specific allegation against these petitioners of assault. Learned counsel submits that the medical report does not support the case of the prosecution. He further submits that the accused persons and the daughter of informant study in the same area and due to some petty dispute, the daughter of informant called him and tried to threaten the other students including the petitioners. Learned counsel submits that petitioners are young boys of 18 years, having got clean antecedent and they undertake to cooperate in the investigation and trial of the case.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.
6. Considering the facts and circumstances of the case, submissions of learned counsel for the parties and the nature of allegation leveled against the petitioners as well as their clean antecedent and the young age of petitioners, in the
Patna High Court CR. MISC. No.24467 of 2026(3) dt.12-05-2026 3/3 event of arrest or surrender before the Court below within six weeks from today, the petitioners be released on bail upon furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount to each to the satisfaction of the learned J.M. 1st Class, Gaya/ concerned Court in connection with Banke Bazar P.S. Case No.178 of 2025, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
