The petitioners apprehend their arrest in Dumariaghat P.S. Case No. 45 of 2014, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code. The petitioners along with other accused persons are alleged to have come while the construction work of the kitchen of the informant was going on. On the order of petitioner no. 1 (Pradeep Patel), Manoj Patel is alleged to have assaulted the informant with farsa on her head.
It is submitted that no specific allegation of assault is made against the petitioners. The case has been compromised. The
Patna High Court Cr.Misc. No.34787 of 2015 (3) dt.29-10-2015 2/2 informant got three injuries, out of which two injuries are lacerated and one is tenderness but all the injuries are simple in nature.
Considering the facts aforesaid, the petitioners above named in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sri G. Mishra, Judicial Magistrate 1st Class, East Champaran at Motihari in connection with Dumariaghat P.S. Case No. 45 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
