Petitioner apprehends his arrest in connection with Shakurabad P.S. Case No. 102 of 2016 registered for the offences punishable under Sections 341, 323, 452, 354A, 354B, 366A, 511 and 506/34 of the Indian Penal Code and under section 8 of POCSO Act.

Allegation against the petitioner and several other accused persons is of kidnapping the minor daughter of the informant but as the informant woke up the accused persons fled away from the place of occurrence.

Submission of learned counsel for the petitioner is that the whole case is false and concocted which will appear from the fact that after investigation police has not found the case true

Patna High Court Cr.Misc. No.20675 of 2018 (2) dt.26-04-2018 2/2 against the petitioner but the learned Magistrate has taken cognizance against him and for the same occurrence two cases have been filed and in another case police has not found the case true against the petitioner.

Having heard both sides and in the facts and circumstances, let the petitioner, above named, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Session Judge-I, Jehanabad, in connection with Shakurabad P.S. Case No. 102 of 2016, subject to the conditions under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
