JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 11-02-2019 The petitioner has a remedy against the impugned order dated 18.08.2012 passed by the Additional Collector, Patna, in Mutation Revision No. 121/1991-92, which he may avail.

It is also admitted at the bar that a suit is pending at the instance of contesting private respondent in the court of learned Sub Judge-II, Patna City, Patna, in respect of same land, also involving same issues which are involved in the mutation proceeding. The petitioner has been noticed for his appearance in the said suit.

There is no gainsay that the revenue authorities cannot

Patna High Court CWJC No.20195 of 2012(5) dt.11-02-2019 2/2 adjudicate upon title of the contesting parties. Therefore, any observation made or findings recorded by the Revenue Court shall not prejudice the case of the parties in the title suit. This application is disposed of with the observation, as above.
