JUSTICE JYOTI SARAN ORAL ORDER 21-08-2015 Mr. Santosh Kumar Sinha learned counsel appearing for the petitioner in C.W.J.C.No.18660 of 2011 and Mr. Raju Giri representing the petitioner in C.W.J.C.No.3318 of 2011, learned counsel for the State and the Corporation are present and have been heard.
Whereas according to Mr. Giri the matter has been rendered infructuous by passage of time inasmuch as the petitioner in C.W.J.C.No.3318 of 2011 has not only been awarded the contract but has also been given extension to the same, as per Mr. Sinha the grievance of the petitioner to claim compensation still subsist for which he seeks permission to raise it before the appropriate authority.
In view of the submissions so advanced by learned counsel for the petitioners in these two writ petitions, the writ petitions are disposed of and the petitioner in C.W.J.C.No.18660 of 2011 if so advanced, may raise his claim for compensation before the appropriate authority and which would be considered on its own merit and disposed of in accordance with law. These writ petitions are disposed of.
