The petitioner apprehends his arrest in connection with G.B. Nagar P.S. Case No. 105 of 2016 registered under Section 409 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that the petitioner, who happens to be the Head Master of the Primary School, has falsely been implicated in this case. The First Information Report is lodged after lapse of two years. Further he submits that on perusal of Measurement Book (Annexure-2), it appears that construction work was in progress till 25.11.2015 by the Engineer.

Having considered the facts and circumstances of

No.25449 of 2019(2) dt.19-04-2019 2/2 the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the C.J.M., Siwan in connection with G.B. Nagar P.S. Case No. 105 of 2016, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
