The petitioners are in custody in connection with Excise Case No.354 of 2020, arising out of Kudra P.S. Case No. 156 of 2020, for the offence under Section 30(A) of the Bihar Prohibition and Excise (Amendment ) Act, 2018. Learned counsel for the petitioners submits that the petitioners have no criminal antecedent and they are in custody since 01.06.2020. In the instant case, total 183.990 litres of foreign liquor was seized.

Considering the fact that the petitioners have no criminal antecedents and they are in custody since 01.06.2020,

Patna High Court CR. MISC. No.24865 of 2020(3) dt.12-10-2020 2/2 the Court is inclined to grant bail to the petitioners subject to the condition that each of the petitioners has to deposit Rs.25,000/- in cash. On depositing the amount of Rs.25,000/-, petitioners, above-named, are directed to be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Kaimur at Bhabua in connection with Excise Case No.354 of 2020, arising out of Kudra P.S. Case No. 156 of 2020.

Deposit of Rs.25,000/- (Rupees twenty thousand) shall abide by final outcome of the instant criminal case. (Anil Kumar Upadhyay, J) BT/- U T
