04-10-2017 Heard Sri Braj Nandan Kumar Tiwary, learned counsel for the petitioner and learned Addl. Public Prosecutor. The present petition has been filed with a prayer to restore Cr. Misc. No. 27673 of 2011, which stood dismissed long back on 31-01-2014, whereas, the present restoration petition was filed in the month of September, 2017. The main application was filed in the year 2011 for quashing of order of cognizance.

Considering the fact that main petition was dismissed on 31-01-2014 and present restoration petition was filed after more than three years from the date of rejection of the main

Patna High Court Cr.Misc. No.42845 of 2017(2) dt.04-10-2017 2/2 petition, which was filed for quashing of order of cognizance in the year 2011, there is no reason to pass any favouable order. The restoration petition stands dismissed.
