2. The petitioners have preferred this application for grant of regular bail in connection with Rajapakar P.S. Case No. 13 of 2024 dated 341, 147, 148, 447, 448, 323, 324, 325, 354, 427, 307 and 379 of the Indian Penal Code.
3. As per the prosecution case, when the informant was at home, in the meantime, the petitioners and the coaccused persons entered the house and brutally assaulted the informant causing severe injuries. The petitioner Manish Kumar hit the informant on her face with daab with intent to kill causing cut injury on her nose. The petitioner Guddu Kumar hit
Patna High Court CR. MISC. No.30250 of 2024(2) dt.30-04-2024 2/3 on the face of the informant with iron rod due to which her two teeth got broken. The co-accused persons namely Raja Kumar and Prince Kumar assaulted the informant's mother-in-law with lathi and rod due to which she got injured. The accused persons took Rs. 15,000/- from the box and snatched a mobile phone from the informant.
4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case due to land dispute. There is a case and counter case between the parties. The injury report of the informant and the opinion is kept reserved. It is further submitted that the petitioners have no concern with the alleged offence. The petitioners have clean antecedent as stated in para 3 of the bail petition. The petitioners are in custody since 25.01.2024.
5. Learned A.P.P. for the State has opposed the bail petition of the petitioners and submitted that there is specific allegation against the petitioners who assaulted the informant with intent to kill.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioners above-named, are directed to be enlarged on bail on furnishing
Patna High Court CR. MISC. No.30250 of 2024(2) dt.30-04-2024 3/3 bail-bond of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court concerned, Vaishali at Hajipur in connection with Rjapakar P.S. Case No. 13 of 2024.
7. The application stands allowed.
