JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 08-08-2019 This application under Article 227 of the Constitution of India has been filed by the intervenor-petitioner for setting aside the order dated 17.01.2019 passed by the Sub-Judge-I, Purnea in Title Suit No. 393 of 2013 whereby his application dated 30.08.2016 filed under Order I, Rule 10(2) of the Code of Civil Procedure for being added as intervenor-defendant in the suit has been rejected.

After some arguments, learned counsel for the petitioner seeks leave to withdraw the present application with liberty to file an application in Title Suit No. 148 of 2015 for impleading the plaintiff of Title Suit No. 393 of 2013 as one of
