JUSTICE PARTHA SARTHY ORAL ORDER 30-09-2020 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Barhara P.S. Case no. 282 of 2018 registered under sections 306 and 34 of the Indian Penal Code.

As per allegation in the FIR, it is stated by the informant that the petitioner had forcibly taken his daughter under threat and coercion. On her return, she committed suicide by taking poison.

It is submitted by learned counsel for the petitioner that the petitioner is in custody since 16.11.2018. His earlier application for bail was rejected vide order dated 14.8.2019 (Annexure-1) wherein this Court had granted liberty to the petitioner to renew his prayer for bail after six months. It is

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the period in custody together with the observation given in order dated 14.8.2019, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Barhara P.S. Case no. 282 of 2018 on furnishing bail bond of Rs. 10,000/ (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur, (Ara).
