The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341/323/307/504/379/34 of the Indian Penal Code. The petitioner and other FIR named accused persons are cousins of the informant. Allegation is of commission of assault and abuse. There is allegation of commission of injury, against the petitioner with dagger, to Rohit Kumar son of the informant. However, injury report of Rohit Kumar is not available on the record; rather available injury report of Guriya Devi, Sonu Kumar and Vikash Kumar reveals that injury caused was by hard and blunt substance.
Considering the general and omnibus nature of
Patna High Court CR. MISC. No.26648 of 2020(3) dt.29-01-2021 2/2 allegation, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court-below where the case is pending in connection with Noorsarai Police Station Case No. 346 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
