2. In the present case, the petitioner are apprehending their arrest in connection with Lakri Nabiganj P.S. Case No. 01 of 2026 registered for the offences under Section 309(4) of B.N.S.
3. As per prosecution case, two miscreants in police uniform stopped the four wheeler of the informant claiming that there was liquor in the vehicle. When the informant rolled down his window glass, the miscreants took away mobile phone kept on the dashboard and attacked the informant with knife and snatched Rs.25,000/-. The name of the

4. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. The petitioners have been made accused in this case on the basis of confessional statement of co-accused Suryabhan Prasad otherwise there is no material against the petitioners. Learned counsel further submits that the co-accused Suryabhan has been granted bail by the learned trial court. The petitioners are not named in the FIR and no material has come against them during investigation except confessional statement. Learned counsel further submits that the petitioner no. 1 is having antecedent of two cases and he is on bail in both the cases. The petitioner no. 2 is having clean antecedent.
5. Learned APP opposes the submission made on behalf of the petitioners.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the clean antecedent of petitioner no. 2 and further considering the possibility of false accusation against him, let the petitioner no. 2 above named, in the event of his arrest or surrender before the court concerned within a period of eight weeks from today, be

No.24348 of 2026(2) dt.24-04-2026 3/3 released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. I, Siwan/concerned court in connection with Lakri Nabiganj P.S. Case No. 01 of 2026, subject to the condition as laid down under Section 482(2) of the B.N.S.S. and other following conditions :
(i) One of the bailors will be a close relative of the petitioner no. 2.
(ii) The petitioner no. 2 will remain present on each and every date fixed by the court below, if so required by the learned trial court.
7. So far as petitioner no. 1 is concerned, since he has criminal antecedent, I am not inclined to grant him anticipatory bail and hence, his prayer for anticipatory bail is rejected. (Arun Kumar Jha, J) DKS/- U T
