The petitioner seeks bail in Raghunathpur P.S. Case No. 109/2018, instituted for offences under Section(s) 379 and 411 of the Indian Penal Code.

It is alleged in the written report that informant had parked his motorcycle in village Patar and gone to attend marriage in the house of his Sadhu. The informant returned from the marriage and found his motorcycle missing. It is further alleged that informant got information that motorcycle lifter was proceeding towards Patar then he rushed towards Patar and caught the thief near petrol pump. Informant identified his motorcycle. The apprehended person disclosed his name as Bimlesh Kumar Dwivedi.

Patna High Court CR. MISC. No.23389 of 2019(2) dt.11-04-2019 2/2 Learned counsel for the petitioner has submitted that the apprehended person disclosed the name of this petitioner in the confessional statement. Nothing has been recovered from the conscious possession of petitioner.

Petitioner is in custody since 28.06.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate VIIIth, Siwan, in connection with Raghunathpur P.S. Case No. 109/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
