JUSTICE SANJAY PRIYA ORAL ORDER 01-12-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Shastri Nagar P.S. Case No. 14 of 2017 instituted for the offence under Section 406 of the Indian Penal Code.
There is very serious allegation against this petitioner that he being the Chief Manager, PNB, BO Raja Bazar, Patna along with other Officers of the Bank broke open the Locker of the informant on 29.9.2014 without informing her and also prepared the inventory showing that no article was found in the locker. The key coffer register of Safe Deposit vault bear signature of the petitioner along with other persons who were present at the time of breaking the locker. The copy of ledger filed by petitioner
Patna High Court Cr.Misc. No.46918 of 2017 (4) dt.01-12-2017 2/2 shows that payment of locker rent was made by the informant up to 25.11.2013. It further appears from copy of record of visit submitted by the petitioner that informant had operated the locker lastly on 29.5.2012. The locker was broke open without informing the informant on 29.9.2014. Therefore, it cannot be said that locker was not operated by informant for long time. This Court finds that said act on the part of bank officials including the petitioner was totally malafide. In such circumstances, this Court is not inclined to grant anticipatory bail to the petitioner.
Prayer for anticipatory bail of the petitioner stands rejected.
The petitioner may surrender in the court below and make prayer for regular bail which shall be considered/disposed off by the court below in accordance with law preferably on same day if the same is possible.
