JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 10-11-2020 Heard learned counsel for the petitioner, the State and the informant through the virtual court proceeding. The petitioner seeks bail in connection with Tatarpur P.S. Case No. 286 of 2019 registered for the offences punishable under Sections 302, 34, 120B of the Indian Penal Code and Section 27 of the Arms Act.
Prosecution case, in brief, is that the elder brother of the informant was caught at his house and the accused persons fired upon him and have committed the murder. Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. but on the confessional statement of the co-accused, petitioner has been made accused in the present case. He further submits that the petitioner is in
Patna High Court CR. MISC. No.23727 of 2020(5) dt.10-11-2020 2/2 jail custody since 13.01.2020. He further submits that similarly situated co-accused has been granted bail by different Benches of this Court. Learned counsel for the petitioner further submits that there is no recovery of any incriminating article from possession of the petitioner. The petitioner has not been put on T.I. Parade.
Learned A.P.P. for the State opposed the bail petition. In the facts and circumstances of the case, let the above named petitioner be enlarged on bail after framing of charge on furnishing bail bond of Rs. 25,000/- (twenty five thousand) only with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VIIth, Bhagalpur in connection with Tatarpur P.S. Case No. 286 of 2019.
