2. The petitioners apprehend their arrest in connection with Halsi P.S. Case No. 304 of 2023 registered under Sections 147, 148, 149, 341, 323, 307, 379, 504 and 506/34 of the Indian Penal Code.
3. The prosecution story, in brief, is that on 17.11.2023 at about 3:00 P.M., in the evening, all the F.I.R. named accused persons including these petitioners armed with lathi-danda and iron rod entered the house of informant and assaulted informant and his family members, as a result of which, they sustained
Patna High Court CR. MISC. No.34645 of 2024(3) dt.13-08-2024 2/3 injuries. It is further alleged that co-accused Arjun Prasad Verma took away Rs. 50,000/- which was meant for customer service point of Banking service.
4. Learned counsel appearing on behalf of the petitioners submits that petitioners are innocent and have falsely been implicated in the present case due to malafide intention. Further submission is that the specific allegation is against co-accused Abhimanyu Prasad Verma. So far as these petitioners are concerned, there is no specific allegation against them. The injuries allegedly caused by these petitioners are simple in nature. Petitioners claim clean antecedent.
5. Learned A.P.P. appearing on behalf of the State opposed the bail application and submits that petitioners are named in the First Information Report with the allegation of assault.
6. Having considered the accusation and the nature of injuries allegedly caused by these petitioners as well as the clean antecedents of the petitioners, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned court below within a period of six weeks from today, on furnishing bail-bonds of Rs. 10,000 (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction
