JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-10-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 366/34 of the Indian Penal Code.

The prosecution case is that daughter-in-law of the informant was enticed away by the petitioner and others. On conclusion of the investigation, final form was submitted and petitioner was charge-sheeted under Sections 494, 498A of the Indian Penal Code, but differing with the final form, cognizance has been taken under Sections 366/34 of the Indian Penal Code.

It is submitted by learned counsel for the petitioner that petitioner has performed marriage with the victim.

Patna High Court Cr.Misc. No.33058 of 2015 (4) dt.30-10-2015 2/2 marriage with the petitioner. In the circumstance, he is not opposing the prayer for anticipatory bail of the petitioner. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Rosera, Samastipur in connection with Hathauri P.S. Case No. 111 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
