JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-12-2015 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 504, 376, 511, 379/34 of the Indian Penal Code. The prosecution case is that the informant was in her field when the accused persons started assaulting her by pushing her down, sat on the chest and pressing her neck with intention to kill. It is alleged against petitioner No. 1 Janki Chauhan that he pushed her down and tried to ravish her, whereas petitioner No. 2 Yogendra Chauhan snatched gold chain, earring and other articles of the informant. Petitioner No. 3 Balgoving Chauhan sat on chest and assaulted with leg. It is submitted by learned counsel for the petitioners that for a petty dispute the petitioners have been roped in the present case. There is counter version of the

Patna High Court Cr.Misc. No.54945 of 2015 (2) dt.04-12-2015 2/2 occurrence and there is no injury report of the informant as she was never been examined by any doctor. A statement to that effect has been made in para 6 of the petition. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Nawada in connection with Sirdala P.S. Case No. 157 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
