The petitioners apprehend their arrest in Mehdiganj P.S. Case No.56 of 2016 registered under Sections 147, 148, 149, 323, 324, 307, 452, 427, 380 and 354 of the Indian Penal Code. The informant, Amarjit Mahto, named altogether 6 accused persons along with other unknown person and alleged that they had come to the shop of the informant and assaulted the informant and his wife and his son, namely, Vikas.
The learned counsel for the petitioner submits that there is counter version being Mehdiganj P.S. No.57 of 2016. Neither the informant nor his wife received any injury. Vikas Kumar, son of the informant examined and no injury was found on this person.
Patna High Court Cr.Misc. No.5156 of 2018 (2) dt.02-02-2018 2/2 Vikas Kumar had been referred to NMCH but he did not go to NMCH for X-ray. There is a land dispute between the parties. Considering the facts aforesaid and the nature of allegation made against the petitioners, the petitioners, above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from the date of receipt / production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Patna City in connection with Mehdiganj P.S. Case No.56 of 2016, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
