This application for regular bail arises out of Gaurichak P.S. Case No. 466 of 2019, disclosing offence punishable under Sections 304-B/34 of the Indian Penal Code.

It is evident from the First Information Report itself that the petitioner and the deceased had married each other out of love for each other on their own sweet will in February 2019. The brother of the deceased, who is the informant, has alleged that there was demand of dowry and the deceased was being tortured therefor, both physically and mentally and she finally died on 01.12.2019.

Learned counsel appearing on behalf of the petitioner has submitted that the petitioner and the deceased were leading a

Patna High Court CR. MISC. No.26836 of 2020(2) dt.19-10-2020 2/2 happy conjugal life but since the deceased was short-tempered, over a petty issue, she committed suicide. It has been argued that there is no chance of the petitioner fleeing from the course of trial, if allowed regular bail by this Court. The petitioner is in custody since 03.12.2019 and charge-sheet has apparently been submitted.

Considering the fact that the allegation of demand of dowry is the only basis for the petitioner's implication in the case under Section 304-B of the IPC, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned Sub-Judge-VI-cum- ACJM-V, Patna City in Gaurichak P.S. Case No. 466 of 2019(G.R. No. 5837 of 2019).
