ANJANA MISHRA ORAL ORDER 30-10-2015 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Buxar(M) P.S. Case No.342 of 2014 for allegedly having committed the offences under Sections 328 and 302/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that the entire case against these petitioners is based on suspicion and there is no material on the record to show that there was any enmity between the wife of the deceased so as to necessitate the occurrence at the hands of his wife or his in-laws, for that matter.

Patna High Court Cr.Misc. No.18856 of 2015 (3) dt.30-10-2015 2/2 Learned counsel for the State, after perusing the case diary, submits that the informant has expressed suspicion that since the deceased had left for his Sasural, these petitioners may have indulged in the aforementioned occurrence; leading to the death of his brother.

Considering the nature of the allegations made against the petitioners and the materials which have been found in the case diary, let all the three petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar, in connection with Buxar(M) P.S. Case No.342 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
