JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 21-10-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Chapra Town P.S. Case No. 359 of 2016, registered under Sections 399, 401, 413 and 414 of the Indian Penal Code. The accusation is that on receiving secret information regarding gathering of miscreants for preparation of committing dacoity at Bhikhari Chowk, Police reached there. On seeing the Policy personnel, they started fleeing, but four persons were apprehended, who disclosed their names as Prakash Kumar, Pintu @ Painter, Kishan Kumar and Shirman @ Ajju, motorcycle and mobile set were found from the possession of them. They also disclosed the name of the petitioner and five others as his associates. Learned counsel for the petitioner submits that it would

No.44211 of 2016 (2) dt.21-10-2016 2/2 appear from the F.I.R. that the name of the petitioner has been disclosed by the co-accused, who apprehended on the spot and except the confessional statement, there is nothing against the petitioner, to show his involvement in the present case. The petitioner having no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran, Chapra in connection with Chapra Town (Nagar) P.S. Case No. 359 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
