3. Vide order dated 08.05.2024, while issuing notice to

Patna High Court CR. MISC. No.49489 of 2016(5) dt.27-07-2026 2/2 opposite party No. 2, proceedings of Complaint Case No. 938 of 2005, pending in the Court of learned Judicial Magistrate 1st Class, Patna City, had been stayed and on account of the operation of the said order, the trial has not progressed in the matter.

4. Learned counsel appearing on behalf of the opposite party No. 2 submits that despite undertaking given by the learned counsel for the petitioner in the Court to settle the account, no steps have been taken till date.

5. In view of non-appearance on behalf of the petitioner, this application is dismissed for non-prosecution.

6. Let a copy of this order be communicated to the Court concerned forthwith.
