The petitioners apprehend their arrest in connection with Rupauli P.S. Case No.142 of 2021 (wrongly mentioned as Rupauli P.S. Case No.143 of 2021 in the prayer portion of the bail application), registered for the offences punishable under Sections 447, 147, 148, 149, 302, 307, 504 and 506 of the Indian Penal Code as well as Section 27 of the Arms Act. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the
Patna High Court CR. MISC. No.25929 of 2022(2) dt.01-09-2022 2/2 present case. The petitioners have got no criminal antecedent as stated in paragraph-3 of the bail application. It is further submitted that the allegation of firing is against co-accused, Md. Kaushar. It is submitted that there is admitted land dispute between the parties and there is case and counter case also. Learned APP for the State opposed the prayer for anticipatory bail of the petitioners.
Taking into consideration the fact that the specific allegation of firing is against Md. Kaushar, let petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bonds of Rs.25,000/- (rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnia in connection with Rupauli P.S. Case No.142 of 2021, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
