JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-04-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402, 120(B) of the Indian Penal Code and Sections 25(1-b)a, 26, 35 of the Arms Act.
One country made loaded pistol and four live cartridges are said to have been recovered when petitioner and others were caught by the police. Petitioner is in jail custody since 15.10.2018 and except the present case as well as one Barauni (Chakia) P. S. Case No. 313 of 2015, petitioner does not have any criminal antecedent.
