JUSTICE ALOK KUMAR PANDEY ORAL ORDER 24-04-2025 In the instant petition, the petitioner has prayed for following reliefs:- "For issuance of a writ in the nature of a writ of mandamus or any other appropriate writ/order/direction to the respondent authorities to take immediate steps to protect the life of the petitioner and his family.

i) For a Direction to the Respondent State as to what the stop my construction work of my land in question Old Khata No. 289 and New Khata No. 1318, Old Khesra No. 959 &

Patna High Court CWJC No.6108 of 2025(2) dt.24-04-2025 2/3 960 and New Khesra No. 1243 an area 59 Decimal of Mauza- Mahtha, Tole-Ladania, Anchal-Ladaniyan within the District of Madhubani over which the petitioner Raiyatee land contained Jamabandi No. 2591, 2534 & 2491.

ii) For a further direction to the Respondent to Demarcation of the aforesaid piece of land in the favour of this petitioner as he is fulfilling all the criteria made in this regard as while at one hand.

iii) For any other relief or reliefs, the Petitioner is entitled for."

Learned counsel for the petitioner submits that the petitioner has filed application before the Circle Officer on 12.10.2023 with regard to the demarcation of land bearing Old Khata No.289 New Khata No.1318, old Khesra No.959 area 21 Decimal (4 Khata 16 Dhur) and Old Khesra No.960 Area 38 Decimal (8 Katha 10 Dhur) for which he has deposited Rs.4,000/- as is evident from Annexure-4 of the writ petition and date was also fixed for measurement on 23.11.2023 but till today, no action has been taken by the concerned authority.

3. Learned counsel for the State submits that it is a matter of record, however, if the petitioner represents his grievance before the competent authority / appropriate forum,

Considering the facts and circumstances of the case and the arguments advanced on behalf of both the parties, the present writ petition is disposed of with liberty to the petitioner to raise his grievance by filing representation before the competent authority / appropriate forum within four weeks from the date of receipt of this order. If the petitioner represents his grievance before the competent authority / appropriate forum within stipulated period of four weeks, the competent authority / appropriate forum is directed to pass appropriate order on the representation of the petitioner within a period of eight weeks from the date of its filing in accordance with law.
