IN THE HIGH COURT OF JUDICATURE AT PATNA
Criminal Miscellaneous No.36827 of 2016 Arising Out of PS.Case No. -133 Year- 2016 Thana -FALKA District- KATIHAR ===================================== Tulsi Kumar Mandal, son of Basudeo Mandal, resident of Village - Bhangha, P.S.- Falka, (Pothia), District - Katihar. .... .... Petitioner/s
Versus
The State of Bihar.
.... .... Opposite Party/s ===================================== Appearance :
For the Petitioner/s : Mr. Bimal Kumar, Adv. For the Opposite Party/s : Mr. Pradeep Narain Kumar, APP ===================================== CORAM: HONOURABLE MR. JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 08-09-2016 Learned counsel, appearing on behalf of the petitioner, is in possession of the case diary of Falka (Pothia) P.S. Case No. 133 of 2016 and he has attempted to make submission on the basis thereof.
This is suggestive of the fact that the petitioner has illegally obtained the case diary, which is a confidential document and part of ongoing investigation; it can, therefore, easily inferred that the petitioner is trying to influence the investigation and causing interference in the said process. On this ground alone, I refuse to exercise my
Patna High Court Cr.Misc. No.36827 of 2016 (2) dt.08-09-2016 2/2 discretion in favour of the petitioner of granting him anticipatory bail.
This application is, accordingly, rejected.
