JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-06-2019 This application, for grant of anticipatory bail, arises out of Bhagwanpur Hatt P.S. Case No. 10 of 2019, disclosing offences under Sections 341, 323, 325, 307, 379, 504 and 34 of the Indian Penal Code.

Allegation against the petitioners is of assault to the informant by means of sword causing injury to him. Submission of learned counsel for the petitioners is that as a matter of fact there is case and counter case between the parties and the dispute arose for an occurrence of 02.01.2019 and both the sides have sustained injuries. It has further been submitted that now the parties have compromised the dispute. It appears that though Vakalatnama has been filed by

Patna High Court CR. MISC. No.25597 of 2019(3) dt.25-06-2019 2/2 on behalf of informant but none has appeared on behalf of the informant today, when the case is called out. Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case, this application is disposed of with direction to the petitioners to surrender in the court below on 05.07.2019 and the court below shall examine and verify the submission with regard to compromize between the parties and if it is found true, the court below shall enlarge the petitioners on bail on furnishing bail bonds of Rs. 25,000 /- (Rs. Twenty Five Thousand) each with the sureties of the like amount each to his own satisfaction, otherwise, he is free to pass any order as he deems fit and proper.
