The petitioner has preferred this application for grant of regular bail in a case registered under section 420 of the Indian Penal Code, sections 63 and 65 of the Copyright Act and sections 102 and 103 of the Trade Mark Act.

As per allegation in the F.I.R., on a raid being conducted on the shop of the petitioner, duplicate plastic tank of the mark 'Supreme Industries Limited' was found being sold in the shop. He was taken into custody.

It is submitted by learned counsel for the petitioner that the allegations as levelled in the F.I.R. are false and concocted. No incriminating article has been recovered from his

Patna High Court CR. MISC. No.35186 of 2021(2) dt.27-08-2021 2/2 shop or possession. He has remained in custody since 10.3.2021 and has no criminal antecedent.

It is submitted by learned counsel for the petitioner that a supplementary affidavit has been filed bringing on record the medical prescriptions with respect to his wife and the urgency in hearing of this case.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the nature of allegations, the petitioner having remained in custody since 10.3.2021, investigation in the case having concluded and the petitioner not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Sultanganj P.S. Case no.58 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st, Bhagalpur.
