The petitioner seeks bail in Jandaha P.S. Case No. 250 of 2020, registered for the offence punishable punishable under Section 30(a)/38(i)/41(i) of the Bihar Prohibition and Excise Act, 2018.

2630 litres of illicit liquor has been recovered from old house of this petitioner and one country made pistol, one revolver and six live cartridges have been recovered from possession of this petitioner.

It is submitted that no recovery has been made from conscious possession of this petitioner. The house in question is in joint possession of the family. For recovery of arms a separate FIR was lodged bearing no. Jandaha PS Case No. 251

Patna High Court CR. MISC. No.36257 of 2021(2) dt.09-12-2021 2/2 of 2020. Petitioner is in custody since 30.01.2021. Investigation is complete.

Considering the period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge II-cum-Excise Court, Vaishali at Hajipur in connection with Jandaha P.S.
