The writ application was filed in 2011 questioning the action of the respondents in forcible harvesting of the wheat crop standing on the plot of the petitioner having an area of 2.50 acres of land purportedly in connection with an order passed by the SubDivisional Officer in a proceeding under sections 144/145 Cr. P.C.. The order is, however, not on record.
Mr. Sinha has rightly pointed out that the application has become infructuous. He, however, submits that the order passed
Patna High Court CWJC No.11284 of 2011 (3) dt.14-09-2015 2/2 by the authority on the basis whereof the harvesting of the crops was made should not affect the case of the petitioner in case a proceeding for declaration of a title and possession is filed in the court of competent civil jurisdiction. Prime facie, the submission appears to be correct and logical.
Be that as it may, considering the fact that the petition has become infructuous, it is dismissed as such. (Kishore Kumar Mandal, J) HR/- U
