Petitioner is apprehending his arrest in connection with Sugauli P.S. Case No. 35 of 2017 registered for the offences punishable under Sections 379 of the Indian Penal Code and Sections 30 and 32 of the Indian Forest Act.
Counsel for the petitioner submits that from the F.I.R. it is evident that the same has been lodged on the report of the chowkidar, although the said report does not form part of the F.I.R. He has further submitted that he has been implicated in this case at the instance of one Harendra Bhagat. He further submits that there is no recovery of stolen articles. The FIR is also devoid of any details and the allegations are vague.

Let the above named petitioner, in the event of his arrest or surrender within four weeks from today, shall be released on bail on his furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran at Motihari in connection with Sugauli P.S. Case No. 35 of 2017, subject to all conditions as laid down in Section 438(2) of Criminal Procedure Code.
