The Petitioner apprehends his arrest in Chhapra Town P.S. Case No.79 of 2017 instituted for the offence under Section(s) 419, 420 Indian Penal Code and Section 4 of the Bihar Examination Control Act pending in the Court of the Chief Judicial Magistrate, Saran at Chapra.
From the impugned order, it appears that the petitioner was earlier given benefit of provision 41(1) of the Code of Criminal Procedure. Accordingly, the learned Additional Sessions Judge by the impugned order directed the petitioner to surrender in the lower Court and make prayer for regular bail. In such circumstances, this application is disposed off with direction to the petitioner to surrender before the Chief
Patna High Court Cr.Misc. No.32356 of 2017 (2) dt.14-07-2017 2/2 Judicial Magistrate, Saran at Chapra, in connection with Chhapra Town P.S. Case No.79 of 2017 within a period of four weeks from today as per the direction of the learned Additional Sessions Judge given in the impugned order and the learned Court below at the time of hearing regular bail application of the petitioner will take into consideration that the petitioner was earlier given benefit of provision 41(1) of the Code of Criminal Procedure.
