2. The petitioner seeks bail in a case registered for the offence punishable under Sections-341, 323, 498(A), 504, 506/34 of the Indian Penal Code and Section-3/4 of Dowry Prohibition Act

3. Allegedly, the accused persons including the petitioner started torturing the informant for non-fulfillment of demand of dowry and consequently, the husband (petitioner) and mother-in-law of the informant put down her on the land and pressed neck with intention to kill her.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated

Patna High Court CR. MISC. No.31263 of 2024(4) dt.08-07-2024 2/2 in this case. It has further been submitted that as a matter of fact, the informant who is wife of the petitioner fled away with someone else and the petitioner lodged Masaurhi P.S. Case No. 534 of 2023 on 01-08-2023. The statement of the victim was recorded in that case and she has specifically stated that she went with some one else. The present case has been lodged after one month and 17 days of lodging of the case by the petitioner.

5. On the otherhand, learned counsel for the informant as well as learned APP for the State has opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Hilsa, Nalanda in connection with Islampur P.S. Case No. 537 of 2023 with condition that the petitioner shall cooperate with the trial and make himself available as and when required by the court.
