JUSTICE ANIL KUMAR SINHA ORAL ORDER 10-01-2023 Learned counsel for the petitioner submits that the petitioner was allotted shed No. C-11 having an area of 2200 sq. ft. in the industrial area of BIADA, Barari at Bhagalpur. He further submits that the petitioner requires more land in the industrial area and recently shed No. C-9 has been vacated by the allottee namely M/s Sai Poly Product having an area of 2200 sq. ft.
The petitioner has filed a representation for allotment of shed No. C-9 before Managing Director, Bihar Industrial Area Development Authority (BIADA), Patna on 18.11.2022.
Patna High Court CWJC No.17049 of 2013(2) dt.10-01-2023 2/2 Accordingly, his submission is that the representation of the petitioner may be considered sympathetically by the authority. Learned counsel for the BIADA submits that if the petitioner applies pursuant to the advertisement published by the BIADA and fulfills the criteria for allotment, the petitioner can be considered for allotment of shed No. C-9.
In view of the submissions made by the parties, this application is disposed with the observation that if BIADA decides to allot shed No. C-9 and advertisement for such allotment is published and if the petitioner applies pursuant to that advertisement and fulfills the criteria fixed under allotment policy, the petitioner shall be considered for allotment of shed No. C-9 in accordance with law.
With the above observation and direction, the writ petition stands disposed of.
