ANJANA MISHRA ORAL ORDER 4 30-10-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioner No. 1 being the elder brother-in-law and petitioner No. 2 being the mother-in-law of the deceased are apprehending their arrest in connection with a case registered for the offences punishable under Sections 304-B, 201, 120B/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that a vague allegation has been made against these petitioners and there is no specific allegation of any overt act against these two petitioners. It is submitted that it is only on presumption that the present case has been lodged naming these petitioners alongwith the husband of the deceased and other family members. Learned counsel for the petitioners submits that there is allegation of having been throttled

Patna High Court Cr.Misc. No.28309 of 2015 (4) dt.30-10-2015 P2/2 the deceased as is evident from the inquest report. However, with regard to role being played by the mother-in-law and brother-inlaw, there is no further material in the case diary to connect theses petitioners.

Considering the aforementioned facts and circumstances and that the petitioner No. 2 (mother-in-law) is an old lady, let the petitioners, in the event of their arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, District-West Champaran in connection with Shikarpur P.S. Case No. 451 of 2014 subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
