JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 11-04-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Charpokhari P.S. Case No. 246 of 2017 for the offence under Sections 341, 323, 324, 326, 307, 120B/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 31.01.2019. He further submits that allegation of firing is against Ritesh Kumar Dubey, who has been granted bail by a co-ordinate Bench of this Court vide order dated 08.10.2018 in Cr. Misc. No. 54556 of 2018.

Considering the fact that the petitioner has got no criminal antecedent and Ritesh Kumar Dubey, against whom

No.23557 of 2019(2) dt.11-04-2019 2/2 there is allegation of firing, has been granted bail, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-X, Bhojpur at Ara in connection with Charpokhari P.S. Case No. 246 of 2017.
