JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 26-07-2017 Heard learned counsel for the petitioner and State and considering the fact that the impugned order was passed way back on 10.04.2014, no useful purpose could be served by keeping this matter pending particularly in view of the submission of the counsel for the petitioner that in the instant case, police after investigation and supervision submitted final form and thereafter, on protest, suo motu order was passed.

Counsel for the petitioner submits that there is absolutely no material to proceed against the petitioner. The application is disposed of with liberty to the petitioner to file appropriate petition for discharge before the court below incorporating all facts and circumstances which renders the pending proceeding. If such application is filed within a period of one month, the court below will pass a reasoned and speaking
