JUSTICE SUDHIR SINGH ORAL ORDER 23-02-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 376 and 313 of the Indian Penal Code. Allegation against the petitioner is that he established sexual relationship with the informant on the pretext of marriage but subsequently, he refused to marry her.
It is submitted on behalf of the petitioner that he has got no criminal antecedent. On assurance of marriage the petitioner is said to have established physical relationship with informant. Subsequently, it is alleged that the petitioner refused to marry the victim and for the said reason the present prosecution case has been instituted. From perusal of the case diary it appears that there is no medical examination report of the victim girl to support the allegation made in the F.I.R.
On behalf of the State, it is submitted that petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on
Patna High Court Cr.Misc. No.54208 of 2015 (3) dt.23-02-2016 2/2 furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari, in connection with Sugouli P.S. Case no. 286 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
