The petitioner apprehends her arrest in Madhuban P.S. Case No. 88 of 2017 instituted for the offence under Sections-272/ 273 of the Indian Penal Code and 30(a) of the Bihar Prohibition & Excise Act, 2016.

As per written report and seizure list, 1.5 litres of country-made liquor were recovered from house of the petitioner. It is mentioned in the written report that seeing the police party, the petitioner and other family members fled away. In such circumstances, there is specific allegation of recovery of illicit liquor from house of the petitioner and hence, this court is not inclined to grant anticipatory bail to the petitioner.

Patna High Court Cr.Misc. No.32800 of 2017 (2) dt.17-07-2017 Accordingly, prayer for anticipatory bail is rejected. The petitioner is directed to surrender in the court below and seek regular bail, which will be considered by the court below on its own merit without being prejudiced by this order.
