JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 14-12-2017 Challenging his conviction, ordered by the Additional Sessions Judge-VI, Begusarai, vide judgment dated 06.05.1994 in S.T. No. 412 of 1992 for the offence under Sections 302/34 of the Indian Penal Code read with Section 27 of the Arms Act, the appellant has filed this appeal.
The appellant has been released on bail on 25.09.1998. When the matter was taken up for consideration on 28.11.2017 and when none appeared for the appellant, it was directed that the bailable warrant of arrest be issued for production of the appellant before this Court today. In pursuance thereto, bailable warrant for arrest of the appellant was issued and the same was forwarded to the Superintendent of Police, Begusarai.

APP (DB) No.267 of 1994 (14) dt.14-12-2017 2/2 The Superintendent of Police, Begusarai, in the process of execution of bailable warrant of arrest, has submitted a report dated 13.12.2017, which goes to show that the sole appellant, namely, Pawan Singh, son of Ram Chandra Singh, has died more than two years back and the certificate to that effect from the Nagar Parishad, Bihat, Begusarai and the death certificate issued have been produced.
In view of the above, it is clear that the sole appellant has died and, therefore, this appeal shall stand abated and it is, accordingly, dismissed as having been abated. (Rajendra Menon, CJ) (Anil Kumar Upadhyay, J) Uday/- U T
