This application for anticipatory bail arises out of Dhanarua P.S.Case N0. 174 of 2017, disclosing offences under Sections 147, 148, 149, 341, 323, 324, 307, 504, 506, 353, 379, 511, 427 of the Indian Penal Code.
There are 20 persons named in the First Information Report including females, who are said to have attempted to get forcibly released two accused persons named in the Dhanarua P.S. Case No. 172 of 2017 indulged in fracas and caused obstruction in due discharge of official duty of the police personnel.
Patna High Court Cr.Misc. No.42938 of 2017(2) dt.19-09-2017 2/2 Learned counsel appearing on behalf of the petitioners has submitted that allegations are general and vague and there is nothing specific against any of these petitioners. He has also been submitted that there is no chance of the petitioners fleeing away from the course of investigation or trial. Considering the above submission, this application is allowed.
Let the petitioners above named in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Masaurhi (Patna) in Dhanarua P.S. Case No. 174 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
