The petitioners seek pre-arrest bail in connection with Banka P.S. Case No. 153 of 2017 registered under Sections 147, 148, 149, 341, 323, 325, 307, 504, 506 and 379 of the Indian Penal Code.

Regard being had to the allegation made against the petitioner no.1 Abhiram Yadav @ Sumit in the first information report that he assaulted with fersa on the head of Hari Yadav, I am not inclined to grant him pre-arrest bail. Accordingly, his

Patna High Court Cr.Misc. No.46229 of 2017 (2) dt.17-10-2017 application for grant of pre-arrest bail is rejected. So far as the petitioner no.2 Chhatu Yadav is concerned, he is said to have assaulted with brick on the head of the informant and the injury found on the person of the informant is simple in nature, in the event of arrest or surrender in the court below within six weeks from today, he is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Banka P.S. Case No. 153 of 2017 subject to the conditions as laid down under Section 438(2) Cr. P.C. (Ashwani Kumar Singh, J.) Sanjeet/- U T
