ANJANA MISHRA ORAL ORDER 19-04-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 06.02.2019 in connection with Special Case No.1331 of 2019 arising out of Danapur P.S. Case No. 101 of 2019 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that on the basis of the statement of one Ashok Kumar that the vehicle in question from which the recoveries were made belongs to the petitioner and the petitioner has been arrested in the present case. It has submitted that the petitioner has no knowledge about such items kept in that vehicle. It has further been submitted that

Patna High Court CR. MISC. No.25260 of 2019(2) dt.19-04-2019 2/2 it is entirely false that the vehicle in question belongs to the petitioner, however, it has come on record that the vehicle in question belongs to the said Ashok Kumar himself and not this petitioner.

Considering the aforementioned facts and circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Patna in connection with Special Case No.1331 of 2019 arising out of Danapur P.S. Case No. 101 of 2019.
