Petitioner being the elder brother of the husband of the informant is apprehending his arrest in a case registered for the offences punishable under Sections 498A, 406, 376 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.

The basic accusation is of torture. It is specifically alleged against the petitioner that he has ravished the informant.

It is submitted by the learned counsel for the petitioner that that petitioner used to reside at Calcutta and maliciously accusation has been levelled against him. It is further submitted that the informant has retracted from the

Patna High Court Cr.Misc. No.50829 of 2015 (2) dt.03-11-2015 initial version and filed a petition to that effect before learned court below.

Let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Jamui Mahila P.S. Case No. 29 of 2015, pending in the court of learned Sub-Divisional Judicial Magistrate, Jamui.

With the above observation this application is disposed of.
