That apart, notice by registered cover with A/D was sent to respondent Nos.5 and 7 and the acknowledgement card has not been received back even though more than 30 days have elapsed after sending of the aforesaid. Accordingly, respondent Nos.5 and 7 are also deemed to have been served.

This is an application for restoration of Second Appeal No.29 of 2010 which was dismissed for default on 13.9.2010. Keeping in view the reasons indicated in the application and finding them to be bona fide, the application is allowed.
