The petitioner has approached this court for grant of anticipatory bail in Complaint Case No. 2632 of 2013 , Tr. No. 1786 of 2016 for the offence under Section 498(A) of the Indian Penal Code and Section 3 of the Dowry Prohibition Act. By way of referring to the impugned order learned counsel for the petitioner submits that it is true that complainant was earlier married with the petitioner but the complainant voluntarily had solemnized second marriage with opposite party
Patna High Court Cr.Misc. No.46651 of 2016 (3) dt.22-11-2016 2/2 no. 3 and only with a view to extort money false case has been instituted.
Learned Additional Public Prosecutor though has opposed the prayer for grant of anticipatory bail, he was not in a position to dispute the fact that before the court below this stand was taken and it was noticed by the court below. Considering the facts and circumstances , in the event of arrest or surrender within a period of six weeks from today, let the petitioner Niraj Kumar Singh @ Guddu Singh @ Niraj Singh be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Saran at Chapra / concerned court in connection with Complaint Case No. 2632 of 2013, Tr. No. 1786 of 2016 subject to the conditions as contemplated under section 438(2) of the Code of Criminal Procedure .
